These Terms are governed by and construed in accordance with the laws of Latvia, the country in which the website's operator (Bongo Corp SIA) has its registered office, as regards the interpretation of the contract. This choice of law does not deprive consumers of the mandatory protection afforded to them by the law of their country of habitual residence.
Consumers resident in the United Kingdom retain the protection of the mandatory provisions of UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. In accordance with section 74 of the Consumer Rights Act 2015, where this contract has a close connection with the United Kingdom, the protection of that Act applies notwithstanding the choice of a foreign governing law. Consumers resident in Australia retain the protection of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). The statutory consumer guarantees set out in Part 3-2 of the Australian Consumer Law cannot be excluded, restricted or modified by contract (sections 64 and 64A), and any term of these conditions which purports to substitute the law of Latvia (or any other foreign law) for the Australian Consumer Law in relation to a supply to a consumer in Australia is, to that extent, of no effect (section 67). Australian consumers may bring proceedings before the courts or consumer tribunals of their State or Territory of habitual residence (for example NCAT, VCAT, QCAT or the equivalent body in their jurisdiction).
Nothing in these Terms excludes or limits any right or remedy that cannot be excluded or limited under the applicable consumer law.
